Terms of Use

These Terms of Use (“Terms”) govern your use of the Roamer iOS app (“Roamer”, “the app”), made by Velocity Apps (“we”, “us”). By downloading or using Roamer you agree to these Terms and to Apple’s Licensed Application End User License Agreement (the “Standard EULA”). If these Terms conflict with the Standard EULA, these Terms apply to the extent permitted.

1. Roamer is not professional advice

Roamer is an organizational tool. It does not give legal, tax, immigration or financial advice, and it does not determine your visa, tax or residency status.

Counters use rules and limits that are simplified, that you configure, or that we provide as a starting point. Laws, visa conditions and tax rules differ by person and change over time, and the app may not reflect your exact situation. Days logged from location or photos can be missing or wrong, for example if tracking was off, your device had no signal, or a photo’s date or location tag was inaccurate. Always check your records and confirm important decisions with the relevant authority or a qualified professional. You are responsible for your travel, stays and filings.

Your travel records are stored on your device, as described in our Privacy Policy. You’re responsible for backing up your device; we can’t recover data we never receive. You can export your trips from the app at any time.

4. License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to use Roamer on Apple devices you own or control, as permitted by the Standard EULA. You agree not to copy, modify, reverse engineer or redistribute the app, to use it unlawfully, or to interfere with its operation.

5. Intellectual property

Roamer, its design, artwork and content belong to Velocity Apps or its licensors. Country map data is from Natural Earth (public domain). Flag artwork is used under the MIT license.

6. Disclaimers

Roamer is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose and non-infringement. We don’t guarantee that the app will be uninterrupted, error-free, or that day counts will be complete or correct.

7. Limitation of liability

To the fullest extent permitted by law, Velocity Apps is not liable for any indirect, incidental, special, consequential or punitive damages, or for any fines, penalties, taxes, visa refusals, overstays or other losses arising from your use of or reliance on Roamer. Our total liability for any claim relating to the app is limited to the amount you paid for Roamer in the 12 months before the claim. Some jurisdictions don’t allow these limits, so they may not apply to you in full.

8. Apple

These Terms are between you and Velocity Apps, not Apple. Apple is not responsible for Roamer or its content, has no obligation to provide maintenance or support, and is not responsible for addressing claims relating to the app. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Changes and termination

We may update Roamer and these Terms. If we make significant changes, we’ll update the date above and let you know in the app. You can stop using Roamer at any time by deleting it. We may suspend access if you breach these Terms.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise.
